¶3The background facts leading to filing of this petition adumbrated herein below :- "The petitioner was appointed on 02.04.1193, as Work-Charged Sectional Assistant in the department of Executive Engineer, PWD [R&B], Phek, Nagaland and since then he has been rendering service for more than 30 years, without being regularized. ¶4The State respondents have filed their affidavit-in-opposition, admitting that the petitioner had put more than 30 years in service and he is entitled to be regularized in terms of OM dated Page No.# 3/4
17.03.2015, and the process for regularization has already been initiated and the service of the petitioner has already been verified by the District Level Verification Committee and it will take some time to complete the process.
¶5Mr. Sentiyanger, learned counsel for the petitioner submits that the petitioner was appointed on 02.04.1993, as Work Charged Sectional Assistant and since then he had put more than 30 years of service, without being regularized. Mr. Sentiyanger further submits that in terms of OM dated 17.03.2015, the petitioner in entitled to be regularized as he had put more than 30 years of service as Work Charged Sectional Assistant. Mr. Sentiyanger further submits that in view of his representation dated 27.03.2023, the respondent authorities have not initiated the process till date and therefore, it is contended to allow the petition, by directing the State respondents to regularize the service of the petitioner.
¶6On the other hand, Mr. Imchen, learned Senior Government Advocate for the State respondents fairly submits that the petitioner had put more than 30 years of service as Work Charged Sectional Assistant in the department of Executive Engineer, PWD [R&B], Phek Nagaland and in terms of the OM dated
17.03.2015, the petitioner is entitled to be regularized. Mr. Imchen further submits that the State has already initiated the process of his regularization and it may take 1 month time to complete the entire process.
¶7Having heard the submissions of learned counsel for both the parties, I have carefully gone through the petition as well as the documents placed on record and also perused the affidavit-in-opposition filed by the State respondents. Page No.# 4/4
¶8Indisputably the petitioner was appointed on
