Heard Mr. Sentiyanger, learned counsel for the petitioner.

¶2The petitioner claims to be an indigenous inhabitant of Wokha district of Nagland hailing from the Lotha-Naga tribe and a permanent resident under Ward No.12 PWD/Zuvotong Ward, Wokha Town Council, Nagaland. The petitioner is aggrieved inasmuch as her name has not been included in the electoral roll for the upcoming 2024 Nagaland Urban Local Body Elections of the said ward. The further case of the petitioner is that he has approached the respondent authorities, however, no step has been taken for inclusion of her name in the electoral list.

¶3To a pointed question made by this Court to the learned counsel for the petitioner as to whether the petitioner has made any representation or filed an appeal under Section 38 of the Nagaland Municipal Act, 2023, the learned counsel for the petitioner submits that no representation has been made and the petitioner had only met the concerned authorities personally.

¶4After hearing the learned counsel for the parties, this writ petition is disposed of directing the petitioner to make a representation before the concerned authorities for inclusion of her name under Ward No.12 PWD/Zuvotong Ward, Wokha Town Council, Nagaland within the course of the day. On receipt of the representation, the concerned authorities shall proceed in accordance with law as prescribed in the Nagaland Municipal Act, 2023.

¶5With the above observations and directions, this writ petition is disposed of.
