Temsumeren Ao v. The State of Nagaland and 5 Ors

ORDER Date : 19-02-2024 Mr. I. Imchen, learned counsel appearing on behalf of the petitioner submits that in view of the subsequent developments which have taken place pursuant to the filing of the writ petition, more particularly the Enquiry Report dated 10.03.2021, the petitioner may be permitted to withdraw the instant writ petition. However, he submits that the withdrawal of the writ petition should not prejudice the petitioner to avail remedies against the Enquiry Report and other consequential reliefs thereupon. Taking into account the above, the instant writ petition, therefore, stands closed on withdrawal. Interim order, if any, stands vacated. This Court, however, observes that the withdrawal of the instant writ petition shall not prejudice the petitioner to assail the Enquiry Report and seek other consequential reliefs, if so otherwise permissible under law.
