ORDER
23.08.2023
Heard Mr. B. Lalramenga, learned counsel for the petitioner, who has filed this writ petition under Article 226 of the Constitution of India, for a direction to the respondent authorities to permit him to participate in the promotion process, from Officer Scale-II to Scale-III being conducted by the respondent Bank. The learned counsel for the petitioner submits that on 23.05.2022, the petitioner submitted a representation before the respondent No. 1 to allow him to participate in the selection process, but the same was rejected. However, vide this Court's Order dated 30.05.2022, the Court had observed that "the ends of justice would be met, if the petitioner was allowed to participate in the selection process for promotion from Officer Scale-II to Scale-III as and when held. However, the result in respect of the petitioner shall be kept in sealed cover and shall not be opened without the leave of this Court." Thereafter, there were two vacant posts of the Officer Middle Management (Scale-III) for the vacancy year of 2023 - 2024 and the petitioner being the eligible candidate, was called for personal interview vide letter dated 05.06.2023. Thereafter, the promotion process was completed and the result was declared vide the General Circular dated 20.06.2023 indicating the name of one Sh. H. Vanlalliana, who was accordingly promoted to fill up one of the vacant posts and with regard to the result of the other vacant post it was kept under sealed cover and it was directed that it would be released, subject to the final Judgment in this writ petition. The learned counsel for the petitioner thus submits that the instant writ petition may be closed, with a direction to the respondents to open the sealed cover, and the result of the instant petitioner is released. Page No.# 3/3 Mr. C. Zoramchhana, learned counsel for the respondents has not objected to the closing of the matter. Having heard the submissions of both the parties, this Court finds that since the petitioner has participated in the promotion process from Officer Scale-II to Scale-III for the vacancy year of 2023 – 2024, the instant writ is allowed to be closed, as prayed for by the learned counsel for the petitioner. The respondents are thus directed to open and release the result of the petition which is said to be kept under sealed cover. Writ Petition (C) No. 54/2022 accordingly stands disposed of with the above direction.
