14.06.2024 The present bail application arises out of an FIR lodged on 20.03.2024 before the Officer-In-Charge, Aizawl police station, which was received and registered as Aizawl P.S. Case No. 96/2024, under Section 408/467/468/34 of IPC. Similarly, another FIR was filed by the business head Mahindra & Mahindra Financial Services Limited before the Officer-In-Charge Crime & Economic Offence Police Station, Aizawl, on 29.03.2024, which was registered as Crime & Economic Offence Police Station Case No. 3/2024. This Court has earlier disposed of an anticipatory bail application being AB No. 7/2024 arising out of the said FIR dated 20.03.2024, but filed by a different accused. However, subsequently, another Anticipatory bail application being AB No. 8/2024 by another accused person came up before this Court, wherein, this Court recused oneself from taking the case because of a potential conflict of interest. Since, the present bail application though by a different accused, however, pertaining to the same FIR, in which this Court has already recused oneself from taking the case, this Court is of the considered view that propriety demands that this Court shall not take this case as well. Accordingly, list this matter before any other appropriate Bench without me (Hon'ble Mr. Justice Kaushik Goswami). JUDGE Comparing Assistant
