Rabea Begum Choudhury and 4 Ors v. The State of Mizoram and 5 Ors

ORDER Date : 03.09.2024 Heard Mr. B. Pathak, learned counsel for the applicant, who submits that the Order dated 20.05.2024, dismissing the writ petition for non-prosecution should be recalled, inasmuch as, the writ petitioner's counsel could not attend to the Court proceedings due to the cause list being uploaded to a date prior to the listing of the Page No.# 3/3 case and as the counsel was unwell. Ms. Vanneihsiami, learned Government Advocate appears for all the respondents. Considering the prayer of the applicant's counsel, the application is allowed subject to the payment of cost of Rs. 5,000/-, which shall be furnished to the Registry of this Court within a week. Registry shall thereafter send the cost money to the Mizoram State Legal Services Authority. The Order dated 20.05.2024 is accordingly recalled subject to the condition mentioned above. List the matter on 18.09.2024.
