Heard Mrs. Dinari T. Azyu, learned counsel for the petitioners. This is a petition filed under article 226 of the Constitution of India for issuance of the appropriate writ against the respondents. The learned counsel for the petitioners submits that the petitioner were appointed as CSS Hindi Teacher under Samagra Shiksha during the period between 2021 and 2022 after successfully appearing before the duly Constitution Selection Board. That on 06.09.2022, the Finance Department (PRU) had issued a notification Page No.# 10/11 with the approval of the Council of Ministers in its meeting held on 30.8.2022 for granting allowances to all employees under Samagra Shiksha. Notification was implemented and allowances as notified were granted to the other employees under Samagra Shiksha w.e.f. 01.06.2022. However, the instant petitioners have not the given the said benefits under the notification inspite of the representation dated 29.08.2023. The learned counsel submits that the respondents have failed to address the representation till date and hence the instant writ petition. Mrs. Mary L. Khiangte, learned Govt. Advocate appears on behalf of the State respondents and accepts notice while Mr. Jonathan Lalrintluanga, learned counsel accepts notice on behalf of the respondent No.6 i.e. State of Samagra Shiksha, Mizoram. The learned counsel for the petitioners submits that at this stage, the respondents may be directed to address the representation submitted by the petitioner dated 29.08.2023. This court considering the limited prayer made by the learned counsel for the petitioners finds it fit to dispose the instant writ petition at the motion stage itself, by directing the respondents to response to the representation submitted by the petitioners dated 29.08.2023, addressed to the State Project Director, Samagra Shiksha, Mizoram, wherein the representation is for a grant of the benefits of allowances issued vide notification under Memorandum No.G.12019/2/2022-FIN(PRU) dated 06.09.2022. Page No.# 11/11 The respondents shall consider and dispose of the representation filed by the petitioners with a speaking order within 3 (three) months, from the date of receiving a certified true copy of this order. Thereafter, if still aggrieved, the petitioners are given the liberty to approach the appropriate court, if so advised. Accordingly, the writ petition No.135/2023 stands disposed of.
