Bamang Roy and 17 Ors v. Dharmendra Pradhan and 6 Ors

Heard the learned counsel for the parties. This interlocutory application has been filed by the petitioner in Cont.Cas.

(C)03(AP)2023, seeking impleadment of the respondent No. 7, namely, Shri Starlie Jamoh, Director (Civil Aviation), Government of Arunachal Pradesh to be arrayed as the party respondent in the Cont.Cas(C)03(AP)2023. Mr. B. Nyaruch, learned counsel for the petitioner submits that the contempt petition has been filed for wilful and deliberate violation of the direction of this Court order, dated 06.09.2022, passed in WA No. 19(AP)2022. At the relevant point of time, the present respondent No. 4 was the Director of the Civil Aviation, Government of Arunachal Pradesh. Presently, the opposite party No. 7, namely, Shri Starlie Jamoh is the Director of the Civil Aviation, Government of Arunachal Pradesh. Consequently, since the directions contained in the order, dated 06.09.2022, passed WA No. 19(AP)2022 having not been complied with as on date, impleadment of the respondent No. 7 namely Shri Starlie Jamoh as a party respondent is stated to be necessary for effective order required to be passed in the contempt petition. Mr. K. Apa, learned counsel appearing on behalf of the respondent no. 6 and submits that there is no objection to the prayer made for impleadment of the party respondent. Page No.# 7/7 Learned counsel for the parties have been heard. The interlocutory application available before us has also been carefully perused. Considering the limited prayer of the petitioner that the respondent No. 7 is the present Director of Civil Aviation, Government of Arunachal Pradesh and also upon consideration of the fact that in the Cont.Cas(C)03(AP)2023, the earlier director of Civil Aviation is respondent No. 4 namely, Shri Repo Ronya, who was arrayed as the party respondent and since it has been submitted that the respondent No. 4, Shri Repo Ronya, have superannuated in the meantime and is succeeded by the present respondent No. 7, this Court is of the view that this Interlocutory Application can be allowed without issuing notice at this stage. Accordingly, this interlocutory application is allowed. Respondent No. 7, Shri Starlie Jamoh is arrayed as party respondent No. 7 in the Cont.Cas(C)03(AP)2023. The petitioner/applicant will file amended cause title showing the particulars of the parties including the newly impleaded respondent No. 7, in the Registry, within one week from today. The Interlocutory Application stands allowed and disposed of.
