Judgment

ORDER Date : 20.01.2023

Heard Ms. G. Ete, learned Additional Senior Government Advocate representing the applicants/State of Arunachal Pradesh and Mr. R. Sonar, learned counsel appearing for the opposite party nos. 1 to 18.

¶2This is an application seeking extension of time by at least for a period of 6 (six) months, to comply with the order dated 27.06.2022, passed by this Court in WP(C)No.87(AP)2022.

¶3Mr. Sonar, learned counsel for the opposite party nos. 1 to 18 has produced before this Court an order dated 06.09.2022, passed in WA No. 19/2022 by the Division Bench of this Court, whereby, in the appeal preferred by the applicants/State of Arunachal Pradesh, challenging the order dated 27.06.2022, passed in WP(C)No. 87/(AP)2022, the Division Bench of this Court while partly allowing the appeal preferred by the applicants/State of Arunachal Pradesh, had further directed the applicants/State of Arunachal Pradesh to pay the compensation for land acquisitions made, strictly, in terms of the direction of the learned Single Judge in the writ petition.

¶4In view of the above, learned counsel for the opposite party, Mr. Sonar contends that the order passed by the learned Single Judge in the writ petition is merged with the order of this Court passed in the writ appeal by the Division Bench.

¶5In view of the above submissions made, I find that if the applicants/State Page No.# 6/6 of Arunachal Pradesh wants to prefer an application seeking extension of time for compliance of the order passed by the learned Single Judge in order dated 27.06.2022, in WP(C)No.87(AP)2022, the said judgment having been merged with the order of this Court dated, 06.09.2022, passed in WA No. 19/2022, any extension of time, if the applicants/State of Arunachal Pradesh wants to seek, it would be by filing an application in the order passed in the writ appeal by the Division Bench of this Court.

¶6Accordingly, this interlocutory application is disposed of, with a liberty granted to the applicants/State of Arunachal Pradesh to approach the Division Bench of this Court for extension of time for compliance of the order, if so advised. JUDGE Comparing Assistant
