The Secretary and Anr v. Bamang Roy and 17 Ors

ORDER Date : 20.03.2023 (Nani Tagia, J) Heard Ms. G. Ete, learned Additional Senior Government Advocate for the appellants. This is an application filed by the Secretary and Director respectively of the Department of Civil Aviation, Government of Arunachal Pradesh, Itanagar, seeking extension of 6 (six) months time to comply with the judgment and order dated 27.06.2022, passed in WP(C)87/2022, which, judgment and order was upheld by the Division Bench of this Court in WA/19/2022 vide order dated 06.09.2022. The judgment and order dated 27.06.2022 passed in WP(C)87/2022, which has been upheld by the Division Bench of this Court in WA/19/2022, vide order dated 06.09.2022, provides for payment of compensation to the petitioners by acquiring their lands under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, within a period of 6 months from the date of the order passed in the writ petition. The period of 6 months from the date of order passed in the writ petition has expired in the month of December, 2022. After the instant application seeking extension of time for a period of 6 months to comply with the order passed in the writ petition as well as writ appeal was filed on 23.01.2023, a period of about 2 months have also passed by. Page No.# 6/6 In view of the above and having regard to the facts and circumstances of the case, we deem it appropriate to grant further 3(three) months to the applicants to comply with the orders passed by this Court in the writ petition as well as in the writ appeal mentioned hereinabove. Interlocutory application is allowed to the extent indicated above and accordingly disposed of.
