ORDER

25.01.2024 Heard Shri K. Lollen, learned counsel for the applicants /writ petitioners.

¶2The applicants are 38 in numbers were amongst the 92 writ petitioners Page No.# 12/12 and by this application, the learned counsel for the applicants has submitted that they do not want to pursue with the writ petition and accordingly their names are prayed to be struck off.

¶3Also heard Shri N. Ratan, learned Additional Advocate General, AP and Shri D. Kamduk, learned Standing Counsel, Land Management Department.

¶4Shri S. Mow, learned counsel, who submits that he has been given power to appear on behalf of the remaining writ petitioners and he has also objected to the prayer in IA.

¶5This Court is however of the opinion that a litigant cannot be forced to continue with a particular litigation. In view of the above, the instant IA is allowed and the applicants (38 in numbers), who are arrayed as the writ petitioner nos. 2, 4, 7, 8, 11, 13, 14, 15, 17, 18, 19, 20, 35, 36, 39, 48, 50, 51, 52, 55, 56, 59, 60, 61, 64, 66, 68, 71, 74, 76, 77, 84, 85, 86, 87, 88, 90 and 91 are struck off from the array of the parties.

¶6It is however clarified that for the sake of simplicity, the serial numbers of the writ petitioners are not required to be changed.
