Heard Mr. K. M. Mahanta, learned counsel for the applicant and Mr. L. Narah, learned counsel for the respondent No. 1. It is submitted by Mr. Narah, learned counsel for the respondents that he is going to submit the Vakalatnama by today itself. On the submission of the learned counsel for the parties, this order is passed accordingly. This is an application under Section 5 of the Limitation Act, 1963 for condonation of delay of 313 days in filing the connected Regular First Appeal against the judgment and decree dated 12.05.2017 passed in Title Suit No. 05/2016, passed by the Civil Judge (Sr) Division, Yupia. It is submitted by the learned counsel for the applicant that the matter has been settled between the parties. Apart from that the grounds of delay has been stated in paragraph No. 2 of the Appeal. On the other hand, Mr. L. Narah, learned counsel for the respondent No. 1 submits that he has no objection if the delay is condoned in filing the connected Appeal. Page No.# 3/3 In view of the submissions made by the learned counsels appearing for the parties, this interlocutory application is allowed. Accordingly, the delay of 313 days in filing the connected appeal is condoned. Interlocutory application stands disposed of. As the Appeal has already been registered, list the matter for admission.
