Khyoda Heri and 12 Ors v. The State of Ap and 4 Ors

ORDER Date : 22.02.2023 Heard Mr. T. Torum, learned counsel for the petitioners. Also heard Ms. P. Sangeeta, learned Government Advocate representing the State respondents No. 1 to 4. The case of the petitioners in this writ petition is that the petitioners had donated land to the Government of Arunachal Pradesh for setting up of Param Putu Administrative Circle. The Chief Secretary to the Government of Arunachal Pradesh vide notification dated 22.10.2019 vide Order No. DAD-62/96/2091 was pleased to order the creation of Param Putu Administrative Circle with camp Headquarter at Loth under Lower Subansiri District. According to the petitioner, pursuant thereto, the respondent authorities through the respondent No. 5 are constructing structures for establishment of Param Putu Administrative Circle at Loth. The grievance of the petitioner is that the place where the structures are being constructed by the respondent authorities for establishment of the Param Putu Administrative Circle, Headquarter at Loth is not within the land which was donated by the petitioners, though it falls within the area ear-marked for establishment of Param Putu Administrative Circle. The petitioners, further contends that Loth falls under the Tajgi Village Reserve Forest area and accordingly, their grievance is that the Headquarter of Param Putu Administrative Circle should not be established at Loth but, Page No.# 6/6 should be established in the land donated by the petitioners. Highlighting the aforesaid grievance of the petitioners, the petitioners states to have submitted a representation dated 14.02.2023 to the Commissioner, District Administration, Government of Arunachal Pradesh, which has not been considered by the Commissioner, District Administration, Government of Upon hearing the learned counsels appearing for the parties, I am of the view that this writ petition can be disposed of at the motion stage itself by directing the Commissioner, District Administration, Government of Arunachal Pradesh to consider and dispose of the representation submitted by the petitioners on 14.02.2023 on its own merit.
