Judgment
ORDER Date : 01-05-2024 Heard Mr. T. T. Tara, learned counsel for the petitioner, who has filed the instant writ petition under Article 226 of the Constitution of India for issuance of the appropriate writ or order to the respondents to regularise the post of the petitioner, who has been appointed as officiating Headmaster/Vice Principal and presently serving in the Government High Secondary School, Boasimla, Kra-Daadi District, Arunachal Pradesh.
¶2The case of the petitioner is that he is aggrieved by the regularisation of the promotion of the private respondents no. 3, 4 & 5 to the post of Headmaster/Vice Principal, while according to him, he is more senior to the respondents since he was given officiating promotion as Headmaster/Vice Principal before the respondents.
¶3The learned counsel for the petitioner submits that the petitioner had submitted a representation dated 14.02.2024 before the Commissioner, (Education) Government of Arunachal Pradesh, Itanagar for consideration of his case so that his promotion may also be considered at par with the Junior Page No.# 3/3 Officers, who were promoted to the post of Deputy Director of School Education and Principal. However, the respondent authority has not considered his representation till date.
¶4The learned counsel for the petitioner submits that the instant writ petition may be disposed of with a direction to the respondent authority to consider the representation filed by the petitioner, dated 14.02.2024 and that he will not press the other prayers which were made by him in the instant writ petition.
¶5Mr. T. Lowang, learned counsel appears on behalf of Mr. T. Tagum, learned Standing counsel for the School Education and submits that the learned Standing counsel is not able to appear today since he is indisposed.
¶6Thus, considering the limited prayer made by the learned only counsel for the petitioner, which is only for a direction to the respondent authority to consider his representation dated 4 14.02.2024, this Court finds it appropriate to dispose of the instant writ petition at the motion stage itself by directing the respondent authority i.e. the Commissioner, (Education) Government of Arunachal Pradesh, Itanagar to consider and dispose of the representation submitted by the petitioner dated 14.02.2024 within a period of 3 (three) months from the date of receipt of the certified copy of this order.
¶7Accordingly, the writ petition stands disposed of as above.
