ORDER Date : 14-03-2024 Heard Mr. K Dabi, learned counsel for the petitioner. This matter has been taken up on virtual mode. The petitioner filed this election petition under the provisions of the Representation of Peoples' Act, 1951 challenging the election of the sole respondent, Shri Markio Tado as a candidate of Indian National Congress Party from 20-Tali (ST) Legislative Assembly Constituency pertaining to Legislative Assembly Election for the State of Arunachal Pradesh, 2014 that was held on 09.04.2014. Later, the petitioner as applicant filed an Interlocutory Application being I.A. (C) No. 109(AP)/2018 praying for withdrawal of this Election Petition and the Court by order dated

13.06.2018 passed in said I.A. (C) No. 109(AP)/2018 directed the applicant/petitioner to issue notice of withdrawal of the said Election Petition in the official Gazette of the State of Arunachal Pradesh through the Registry of the said Court and thereafter, the petitioner was directed to file an affidavit with a copy of such Gazette Notification published in the State Gazette of Arunachal Pradesh. However, the applicant/petitioner did not comply with the said direction of the Court dated 13.06.2018 passed in I.A. (C) No. 109(AP)/2018 and as such, the said I.A. (C) No. 109(AP)/2018 along with this petition are pending for disposal. In the meanwhile, the term of the Arunachal Pradesh State Legislative Assembly to which election was held during April, 2014, including that of 20-Tali (ST) Legislative Assembly Page No.# 3/3 Constituency to which the election was held on 09.04.2014, had already been over and therefore, nothing remains to adjudicate in this petition.
