ORDER Date : 11.09.2024
Heard Mr. T. Taba, learned counsel for the petitioners. Also heard Ms. T. Jini, learned Additional Public Prosecutor for the State of Arunachal Pradesh. This is an application under Section 482 of the Cr.P.C., 1973, praying for quashing and setting aside the proceedings of G. R. Case No. 203 of 2011, corresponding to Itanagar P.S. Case No. 119/2011 under Sections 341/323/34 of the IPC. I have considered the submissions made by the learned counsels of both sides. The offences under Sections 341 and 323 of the IPC are compoundable under Section 340 of the Cr.P.C, 1973. Therefore, there is no necessity to exercise the power under Section 482 of the Cr.P.C., 1973 by this Court. The petitioners are advised to approach the Trial Court for compounding the offence.
