At this stage, Ms Jini, learned counsel for the applicant submits that this interlocutory application for condonation of delay was filed with wrong assumption that there was a delay of 35 days in filing the connected CRP; however, she having realized that as per the Section 12 sub-Section 2 of the Limitation Act, the limitation starts running from the date of receipt of the certified copy of the order.

In the instant case, the impugned order was passed on

09.02.2024; the applicant applied for the certified copy of the said order on 12.02.2024, and the certified copy of the impugned order was provided to the applicant on 17.05.2024, and as such, there is no delay in filing the connected CRP No.23(AP)/2024.

In view of the above, Ms Jini, learned counsel for the applicant prays for allowing her to withdraw this interlocutory application as there is no delay in filing the connected Civil Revision Petition.

Prayer is allowed.

Accordingly, this interlocutory application is disposed of on withdrawal. Page No.# 3/3

In view of the above, the Registry shall do the needful with regard to the serial No.8 of the Check list of the CRP 23 (AP)/2024, and list the same tomorrow i.e. on 19.06.2024.
