Also heard Ms. G. Ete, learned Addl. Senior Government Advocate representing the respondents no. 3, 4 & 6. This is an application for striking out the respondents/opposite parties no. 6 & 7 from the memo of writ appeal being WA/4(AP)2023 as well as from the cause title of Interlocutory application being IA(C)/37(AP)2023 contending that the respondents/opposite parties no. 6 & 7 herein, who have been arrayed as respondents/opposite parties no. 6 & 7 in the writ appeal and the connected interlocutory application were not a party in the writ petition being WP(C)64(AP)2014. The connected writ appeal having been preferred against the Judgment and Order dated 08.08.2022 passed by the learned Single Judge in WP(C)64(AP)2014, where the respondents no. 6 & 7 were not a party; are therefore not a necessary party in the WA/4(AP)2023 as well as in IA(C)/37(AP)2023. Upon consideration of the contention raised, this interlocutory application is allowed.
