Judgment

ORDER Date : 30.09.2024 Heard Mr. K. Mibang, learned counsel for the petitioner and also heard Mr. T. Tagum, learned counsel for the alleged contemnors. By filing this contempt petition, the petitioner has alleged willful disobedience and violation of the order dated 12.08.2024, passed by this Court in WP(C)314/2022. This Court on 07.08.2024, in WP(C)314/2024 has directed to maintain status quo in respect of the transfer of the petitioner, but on the same day, the petitioner was released to enable her to join new place of posting at GUPS, Dingliang, Anjaw District, Hawai. The said release order having been issued during the currency of the status quo order, was brought on record before this Court by the petitioner. Vide order dated 12.08.2024, while permitting the petitioner to bring such document on record, considering that status quo was operative, this Court provided that the release order dated 07.08.2024 shall not be given effect to. Accordingly, the respondent authorities have revoked the order of release on 13.08.2024. It is submitted by the learned counsel for the alleged contemnors that the petitioner has been allowed to continue in her earlier place of posting at Hayuliang, immediately after the receipt of the order of this Court dated

12.08.2024 as the release order was passed on the same day when the earlier status quo order was passed by this Court. He further submits that the petitioner is continuing in the same place of posting and regularly she is being Page No.# 3/3 paid her regular salary in the same school. Having considered that the release order has been revoked immediately after the order of this Court on 13.08.2024, I am of the view that there is no willful disobedience of the order of this Court and no contempt of Court on the part of the respondents is made out. Accordingly, the contempt petition stands dismissed and closed. JUDGE Comparing Assistant
