Nang Promila Hokew v. The State of Ap

ORDER Date : 03-09-2024 Heard Mr. A. Gamre, learned counsel for the petitioner. Also heard Ms T. Jini, learned Additional Public Prosecutor for the State respondent.

This is an application filed under Section 483 of the BNSS 2023 Page No.# 2/2 praying for grant of bail to the petitioner who was arrested in connection with Namsai P.S. Case No. 51/2024, under Section 21 (b) NDPS Act.

Two amounts each containing 11.82 grams and 11.70 grams of suspected Heroin was recovered from the possession of the present petitioner, Smti. Nang Sila Singkai.

The only ground for grant of bail taken by the petitioner is that during the seizure, the Investigating Officer violated Sections 42(1)

(2) and 50 of the NDPS Act, 1985.

I have considered the submissions made by the learned counsel for both the sides.

The grounds taken are not good ground because those grounds are to be proved at the time of trial.

Apart from the aforesaid ground, no other grounds has been taken by the petitioner, therefore, the present bail application is found to be devoid of merit and stands dismissed, accordingly.
