-BEFORE-HON'BLE MR. JUSTICE BUDI HABUNG

04.10.2024 Heard Mr. G. Bam, learned counsel for the petitioner and Mr. G. Tado, learned Addl. PP for the State of Arunachal Pradesh. This is an application under Section 482 of the BNSS, 2023 praying for grant of interim-pre arrest bail apprehending his arrest in connection with Basar P.S. Case No. 19/2023 under Section 417/420 of the Indian Penal Code. By an order dated 26.09.2024, this Court while calling for the scanned copies of the Case Diary has granted interim anticipatory bail to the accused Page No.# 2/3 petitioner with a direction that in the event of the accused petitioner, namely, Libom Boje is being arrested in connection with the Basar P.S. Case No.19/2023 under Section 417/420 of the Indian Penal Code, he shall be released on interim anticipatory bail on execution of bail bond of Rs.15,000/- with 2 (two) sureties of like amount with a further direction that the accused petitioner shall co-operate with the investigation of the case and shall appear before the I.O. of the case within a period of 7 (seven) days. The learned counsel for the petitioner submits that in pursuance to the said direction, the accused petitioner; namely, Libom Boje had appeared before the I.O. of the case at Basar on 29.09.2024. It is further submitted that on such appearance before the I.O. of the case, the accused petitioner, namely, Libom Boje was arrested by the I.O. of the case in connection with the above Basar P.S. Case No. 19/2023. However, after completion of all the formalities including recording of his statement, the accused petitioner was released on interim anticipatory bail on the strength of the bail order dated 26.09.2024 granted by this Court. The learned Addl. PP Mr. G. Tado has produced the Case Diary today and fairly submitted that as directed by this Court, the accused petitioner had appeared before the I.O. of the case and on such appearance; he was examined, interrogated and thereafter, he was released on execution of bail bond of Rs.15,000/- with 2 (two) sureties of like amount as directed in the order dated 26.09.2024. In view of the above, since the accused petitioner has already been arrested and subsequently released on bail on furnishing a bail bond on the terms and conditions as prescribed in bail order dated 26.09.2024, this bail application has become infructuous. Accordingly, the interim anticipatory bail granted to the accused petitioner Page No.# 3/3 on 26.09.2024 by this Court is hereby regularized and made absolute with the same terms and conditions with the further condition that the accused petitioner shall co-operate and appear before the I.O. of the case as well as the Trial Court as and when called for. This bail order shall be read along with the bail order dated 26.09.2024. With the above, this bail application stands allowed and disposed of. JUDGE Comparing Assistant
