Sajit Kumar Singh v. Ego Riba

ORDER Date : 21-10-2024 Heard Mr. D. Ado, learned counsel for the applicant and Mr. M. Khambo, learned counsel for the opposite party.

The present application has been filed for substitution of the sole appellant in the connected first appeal i.e. RFA No.03 (AP)/2024. The Page No.# 2/2 sole appellant had expired on 18.12.2023 and the present applicant being the legal heir of the deceased appellant has preferred the present application to substitute himself.

Learned counsel for the opposite party has not objected such prayer.

Considering the pleadings made in the present application and after perusal of the same, this Court is of the view that present applicant be impleaded as appellant in place of the deceased appellant in RFA No.03(AP)/2021, inasmuch as the right to sue survives. Accordingly, the present interlocutory application stands allowed.

Registry to do the needful for correction of the causetitle of the connected appeal i.e. RFA No.03(AP)/2021.
