ORDER Date : 28-08-2024 Heard Mr. Muk Pertin, learned Sr. counsel for the Gauhati High Court, Itanagar Bench assisted by Ms. T.Y. Bhutia, learned counsel for the petitioner and Mr. O. Modi, learned counsel for the contemnor/respondent. Page No.# 2/3 By the order dated 22/09/2023 passed by this Court in W.P.(C) No. 452(AP)/2023, the order dated 28/08/2023, issued by the Commissioner (Education), Government of Arunachal Pradesh, Itanagar transferring the petitioner in W.P.(C) No. 452(AP)/2023 was stayed till the disposal of the writ petition. The order dated 22/09/2023 was however not complied and therefore, this Court by the order dated 17/11/2023 initiated the Suo Moto contempt proceeding against the Deputy Commissioner, East Siang District, Pasighat namely, Tai Taggu for wilful violation of the order dated 22/09/2023 passed in W.P.(C) No. 452(AP)/2023. Mr. O. Modi has filed the affidavit on behalf of the contemnor/respondent seeking for unconditional apology. In the affidavit, the order dated 01/02/2024 passed by the Deputy Commissioner, East Siang District, Pasighat is enclosed wherein, it has been stated that as per the order dated 22/09/2023 passed in W.P.(C) No. 452(AP)/2023, the joining report of Shri. JonggeYiranghas been accepted on 20/11/2023 and consequent thereto Shri. JonggeYirang, DDSE, Pasighat has been released from the establishment of the Deputy Commissioner, East Siang District, Pasighat to enable him to join to the new place of posting at Longding district as DDSE, Longding. Mr. O. Modi, learned counsel submits that by passing the order dated 01/02/2024, the contemnor/respondent has complied with the Page No.# 3/3 order passed by this Court. Mr. Muk Pertin, learned Sr. counsel and the Standing counsel for the Gauhati High Court, Itanagar Bench also submits that the order dated 01/02/2024 passed by the contemnor/respondent satisfies the order dated 22/09/2023 passed by this Court. In the light of the submission made by the learned counsel for the parties and considering that the contemnor/respondent has passed the order dated 01/02/2024 complying with the order passed by this Court, the contempt petition is closed. the contemnor/respondent is accepted.
