ORDER Date : 07.12.2023 Heard Mr. M. Batt, learned counsel for the review petitioner. Also heard Mr. S. Tapin, learned Senior Govt. Advocate appearing for respondent no.2. There is no representation from the respondent nos.1, 3 and 4.

¶2This review petition is directed against the judgment and order dated

22.07.2022, passed by this Court in WP(C) 291(AP)/2019 on the ground that the name of the review petitioner is at Sl. No. 36 of the merit list from amongst persons with disabilities and that the respondent no.6, who was the petitioner in the said writ petition, his name appeared at Sl. No. 45. It is also projected that there is another person with disabilities, whose name appeared at Sl. No. 43, who also ranks above the respondent no.6.

¶3The learned counsel for the review petitioner has also brought to the notice of the Court that this Court by order dated 05.12.2023, passed in Review Pet. No. 13(AP)/2022 had closed the review petition on the ground that the order under review would not come in the way of the Govt. in the Education Department to consider the entitlement to appointment strictly in order of merit and pass appropriate orders for selection and appointment of Assistant Professor, Hindi, 2019 Batch from amongst candidate short-listed by the APPSC.

¶4Accordingly, the learned counsel for the petitioner has prayed that in view of the order dated 05.12.2023, passed in review petition no. 13(AP)/2022, this review petition shall be closed, however, with liberty to make representation before the Education Department to bring to its notice that the name of the petitioner appears at Sl. No. 36, which is above the respondent no.6. Page No.# 4/4

¶5In view of order dated 05.12.2023, passed in review petition no. 13(AP)/2022, this review petition stands closed with liberty to the petitioner to submit a representation before the Director of Higher and Technical Education, Govt. of Arunachal Pradesh to take into consideration the projection of the petitioner that his name appears at Sl. No. 36 of the merit list prepared by the APPSC for selection and appointment to the post of Assistant Professor, Hindi in respect of 2019 Batch.

¶6With the aforesaid observation, this review petition stands closed.

¶7The petitioner is at liberty to produce a certified copy of this order before the concerned authorities along with the representation, if so advised.

¶8The learned counsel for the petitioner shall also provide a downloaded copy of this order to the learned standing counsel for the respondent nos.1, 3 and 4.
