Judgment
ORDER Date : 22-12-2023 Heard Mr. T. Tapak, learned counsel for the petitioner. Also heard Ms. G. Ete, Page No.# 2/3 learned Additional Senior Government Advocate for the State respondents.
¶2On 18.12.2023, this Court had directed the learned Additional Senior Government Advocate to obtain instruction in view of the nature of the grievance raised in this writ petition. However, the learned Additional Senior Government Advocate expressed her inability to obtain the instruction though she has sent a communication on 18.12.2023.
¶3In view of the nature of the grievance raised by the petitioner in this writ petition, I propose to dispose of the same in the motion stage itself.
¶4The grievance of the petitioner is that the petitioner has purchased a .22 rifle on the basis of the arms license issued by the respondent authority. The arms license being License No. LN03161A7A6CE19 and corresponding Unique ID Number 031611002460462019 was issued on 05.02.2019. Since the said licence has expired, the petitioner has applied for renewal of the same. However, the respondent authority has failed to renew the same for which the petitioner is unable to carry his gun, which was purchased on being duly issued a licence to the petitioner. The petitioner has filed two representations before the respondent authority for renewal of his license but there is no response as on date. Therefore, the petitioner prays for a direction to the respondent authority to dispose of the representations which the petitioner has submitted on 18.07.2022 and 13.09.2022.
¶5Ms. G. Ete, learned Additional Senior Government Advocate has no objection for a direction to dispose of the representations of the petitioner. However, with a caveat that the same may be done in accordance with law. Page No.# 3/3
¶6Having considered the submissions of the learned counsel appearing for the parties and on perusal of the documents annexed to the writ petition, I consider it appropriate to direct the respondent authority to dispose of the representations of the petitioner.
¶7Accordingly, this writ petition is disposed of with a direction to the respondent no. 3, i.e. The District Magistrate-cum-Deputy Commissioner, Pasighat, District East Siang to consider and dispose of the representations of the petitioner dated 18.07.2022 and 13.09.2022, which the petitioner has filed for renewal of his arms license being License No. LN03161A7A6CE19 and corresponding Unique ID Number 031611002460462019 issued on 05.02.2019. Such renewal may be made, as may be permissible under the Act and Rules.
¶8The writ petition stands disposed of. JUDGE Comparing Assistant
