Heard Mr. A. Sahni, the learned counsel assisted by Mr. D.K. Baidya, learned counsel for the petitioner. Also heard Ms. L. Hage, learned Addl. PP for the State respondent and Mr. M. Tanga, learned counsel for the respondent/informant.

¶2This is an application under Section 438 of the CrPC, 1973 for release of the Page No.# 2/2 accused petitioner i.e. Sh. Sunil Bhardwaj@ Sunil Kumar Bharadwaj, on bail in the event of his arrest in connection with the Naharlagun PS Case No. 19/2023 registered under Sections 419/420/465/471 and 120B of the Indian Penal Code.

¶3Pertinent that by Order dated 21.12.2023, this Court granted the privilege of interim pre-arrest bail to the petitioner subject to the conditions.

¶4Ms. L. Hage, Addl. PP for the State respondent submits that pursuant to the aforesaid order, the petitioner appeared before the Investigating Officer (IO) and his statement has been recorded under Section 161 CrPC. She further submits that the investigation has been completed and the case has been charge-sheeted vide NLG. PS CS No. 15/24 dated 04.03.2024 registered under Sections 120B/419/420/465/471/468 IPC.

¶5In view of the above, the anticipatory bail application stands disposed with a direction to the petitioner to appear before the learned Court below within 10(ten) days and seek regular bail, if so advised. If such bail application is filed, the same shall be disposed of in accordance with law.

¶6Interim order passed earlier on 21.12.2023 shall continue till the appearance of the petitioner before the learned Court below within the specified period.

¶7A copy of the WT Message received by Ms. L. Hage, Addl. PP is kept on record and marked as 'X'.
