ORDER

The petitioner purchased an extent of 49.5 cents in Survey No.485/1C and an extent of 58 cents in Survey No.485/1B from one Mr.R.C.Durairaj under sale deed dated 19.08.2025. Upon the said sale deed being presented for registration, by impugned refusal check slip dated 21.08.2025, the request for registration was refused.

¶2Learned counsel for the petitioner submits that multiple registered conveyances are on record in relation to the said properties under Document Nos.3350 of 2010, 298 of 2021, 1492 of 2021 and 6976 of 2021. In those circumstances, he submits that the refusal to register the document on the basis of Document No.1443 of 2003 dated 25.08.2023 is untenable. Page3 of 5

¶3Mr.Stalin Abimanyu, learned Additional Government Pleader, accepts notice for both the respondents. By referring to the impugned order, he submits that the request for registration was refused because an extent exceeding the available extent in Survey No.485/1C stands conveyed under registered documents. He also submits that the petitioner may provide an explanation and that a speaking order under Section 71 of the Registration Act, 1908 would be issued.

¶4The petitioner has placed on record multiple conveyances subsequent to Document No.1443 of 2003 dated 25.08.2023. The request for registration in respect of the said conveyances have been accepted. He has also submitted copies of pattas in the names of the petitioner's vendor in respect of the extents sought to be conveyed to the petitioner. In those circumstances, the impugned refusal cannot be sustained and is hereby set aside.

¶5As a corollary, this writ petition is disposed of on the following terms:

(i) The petitioner shall re-present the sale deed for registration within two weeks from the date of receipt of a copy of this order.

(ii) Subject to fulfilment of other requirements relating to registration, Page4 of 5 within two weeks from the date of re-presentation, the registering officer shall either register the sale deed or issue a speaking order of refusal under Section 71 of the Registration Act, 1908 after providing a reasonable opportunity to the petitioner.
