Judgment

ORDER This Writ Petition has been filed seeking to direct the respondents to pay difference in leave salary, difference in gratuity and pension arrears as per 15th wage settlement dated 29.05.2025 with 10% interest to the petitioners.

¶2Ms.S.Pavithra, learned counsel takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

¶3The case of the petitioners is that the petitioners joined the services of the respondent Corporation as Driver and Helper Trainee on 24.03.1992 and

08.07.1989, respectively. At the time of their retirement between on 30.04.2024, they were holding the post of Special Grade Driver and Senior T.M. Since the petitioners were in service as on 01.09.2023, they are entitled to the benefit of 15th Wage Settlement, however, the retirement benefits were settled to them, without revising their basic pay. Therefore, the petitioners made representations dated 25.11.2025, seeking to pay the difference in gratuity, leave salary and pension arrears, along with interest. However, neither of the representations has been considered till date. Therefore, the petitioners have preferred the present Writ Petition.

¶4Learned Counsel appearing for the petitioners submit that it would suffice, if this Court issues a direction to the respondents to consider the representations of the petitioners dated 25.11.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.

¶5On the above contention, this Court heard the learned counsel appearing for the respondent.

¶6In view of the limited relief sought for by the petitioners, this Court without expressing any opinion on the merits of the case, directs the respondents to consider the petitioners' representations dated 25.11.2025, on merits and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioners and any other interested parties. It is made clear that the petitioners would be entitled to interest @ 6% per annum for the benefits to which they are entitled to towards belated payment.

¶7This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. 27-01-2026 Anu (2/5) Index:Yes/No Speaking/Non-speaking order Internet:Yes To
