ORDER Tracing title from registered sale deed dated 07.05.1985 bearing document no.850/1985, the petitioner and his brother decided to partition properties relinquished under earlier partition deed bearing document no.3676/2006. When partition deed dated 21.11.2025 was presented for registration, the registering officer issued the impugned refusal check slip.
¶2Adverting to earlier partition deed dated 23.03.2006, learned counsel for the petitioner submits that the parties thereto had relinquished their rights in the properties forming the subject of the present partition deed. Therefore, he submits that the impugned refusal order is liable to be set aside.
¶3Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for both the respondents. Referring to the impugned refusal check slip, he submits that the order of refusal was issued because all the legal heirs of Kunavathi Ammal were not made parties thereto. In any event, in view of the submission that such persons relinquished their rights under partition deed bearing document no.3676/2006, he submits that the registering officer would reconsider the matter.
