Judgment
ORDER This petition has been filed seeking modification of one of the conditions imposed on the petitioner by the II Additional District and Sessions Judge, Arakkonam, while allowing the bail petition in Crl.MP.No.168 of 2025 dated 15.09.2025.
¶2The learned counsel for the petitioner submitted that the Court below while enlarging the petitioner on bail on 15.09.2025 in Crl.MP.No. 168 of 2025 had imposed certain conditions and one such conditions is that "the petitioner /A4 is ordered to be enlarged on bail on executing a bond for a sum of Rs.25,000/- with two sureties for a likesum each to the satisfaction of this Court, among them, one must be a Government Servant and the other surety must be his blood relative". The learned counsel for the petitioner further submitted that the petitioner is not having any Government surety and blood surety, therefore, still the petitioner was not executing the sureties before the court concerned and the petitioner is in judicial custody from 13.08.2025 (through PT Warrant) even after the bail was granted. Hence, he seeks for modification of the above said condition.
¶3The learned Government Advocate(Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is not able to comply the conditions imposed on him. Hence, he vehemently opposed to allow the petition.
¶4Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side).
¶5Taking into consideration the facts and the submissions made by both counsel and also considering the period of incarceration undergone by the petitioner, the condition imposed as against the petitioner/accused is modified to the effect that " the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/-(Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned II Additional District and Sessions Judge, Arakkonam, Ranipet District. All other conditions remain unaltered.
