Judgment

ORDER Asserting title to the relevant property under settlement deed dated 28.11.2020, the petitioner challenges the order dated

12.01.2026.

¶2Learned counsel for the petitioner submits that the petitioner has not received compensation and that such compensation was also not received by her predecessor in interest. She also adds that the predecessor in interest, Mr.V.R.Umesh Kumar, is her son.

¶3Mr.Abishek Murthy, learned Government Advocate, accepts notice for all the respondents. By referring to internal page No.2 of the impugned order, he submits that it is recorded therein that Award No.1 of 2008 was issued determining compensation at Rs.1,190/- per cent. He also points out that such award is for an aggregate sum of Rs.2,27,450/- in favour of Mr.V.R.Umesh Kumar. The settlement deed in favour of the petitioner was executed on

28.11.2020. The award has been issued in the year 2008 when the owner of the property was Mr.V.R.Umesh Kumar. Therefore, Mr.V.R.Umesh Kumar should take necessary steps to receive the compensation. Instead, the petitioner has approached this Court for payment of compensation. The request of the petitioner cannot be countenanced. By leaving it open to Mr.V.R.Umesh Kumar to claim the compensation in accordance with law, this writ petition is disposed of. There shall be no order as to costs.
