Archana, Govt Advocate CRL OP No. 1813 of 2026 For petitioner: M/s Adhishree Manokaran For Respondent: Ms.J.R. Archana, Govt Advocate COMMON ORDER The petitioners, who apprehends arrest for the alleged offence under Section 127, 319(2), 309(3) of BNSS, 2023 in Crime No.18 of 2026 on the file of the respondent police seeks anticipatory bail.
¶2The allegation against the petitioners is that the petitioners along with other accused, followed the defacto complainant, falsely representing themselves as Customs Officers and snatched 55 soverigns of gold jewels and a sum of Rs.16,000/- from her. Subsequently, the defacto complainant realised that the persons who had snatched the gold and money were not Custom Officers. Hence, she lodged a complaint and a case has been registered.
¶3This court has earlier considered the submission made by both sides and passed an order on 09.02.2026, wherein a direction was issued to the first petitioner in Crl.O.P.No.1813 of 2026 to deposit 55 soverigns of gold and a sum of Rs.16,000/- before the concerned Court on or before 24.02.2026.
¶4The learned Government Advocate submitted that so far property is recovered and there are one previous case pending against the petitioner in both the Crl.O.Ps. He further submitted that inspite of the orders passed by this Court on 09.02.2026 the first petitioner have not complied with the same . Hence he opposed to grant bail to the petitioners.
¶5Considering the serious nature of allegations and so far no property is recovered from the petitioners and the petitioners failed to comply with the orders passed by this Court on 09.02.2026, if the petitioners are granted anticipatory bail, there is likelihood of hampering the investigation, hence, this court is not inclined to grant anticipatory bail to the petitioners. Accordingly, these criminal original petition are dismissed. 24-02-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes smn To
