2.The allegation against the petitioner is that the petitioners along with other accused, attacked the complainant and due to previous enmity, dumped sand on his land. They also taken away gold jewels worth about Rs.2 lakhs. Hence, the case has been registered.
¶3The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.
¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that out of two sovereigns of gold jewels one and a half sovereigns have been recovered and the remaining yet to be recovered and the investigation in this case is pending. She further submitted that there is one previous case pending against the petitioners. Hence, opposed to grant anticipatory bail to the petitioners.
¶5Considering the above fact and circumstances of the case and the injured has been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
¶6Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy made ready, before the learned Judicial Magistrate, Thirukoilur, on condition that the petitioner shall execute a separate bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further condition:

State of Kerala [(2005) AIR SCW 5560];
(e) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS. 30-01-2026 Mpa Index:Yes/No Speaking/Non-speaking order Internet:Yes To
