Judgment
O R D E R This contempt petition is filed alleging willful disobedience and non-compliance with the order dated 01.02.2024 in W.P.No.1657 of 2021.
¶2When the contempt petition is taken up for hearing on admission, the learned Government Advocate appearing on behalf of the respondents submitted that the respondents have complied with the direction of this Court by considering the representation of the petitioner as directed by this Court by proceedings dated 02.05.2024.
¶3The learned Standing Counsel appearing on behalf of the respondents further submits that the respondents had disposed of the representation of the petitioner as directed by this Court in W.P.No.1657 of 2021, and had communicated a copy of the said proceedings to the petitioner through proper channel. The petitioner had received the same in person and affixed his signature acknowledging the receipt of the proceedings on
06.06.2024 at 11.55 a.m.,
¶4The learned Government Advocate further submits that suppressing the aforesaid fact, the present contempt petition has been filed.
¶5Submitting as above, the learned Government Advocate has placed before this Court a copy of the proceedings dated 02.05.2024, along with the receipt of the said proceedings by the petitioner bearing his signature on
06.06.2024 at 11.55 am, as forwarded to him by the respondents under a covering letter dated 06.06.2024.
¶6The copy of the aforesaid proceedings as placed by the learned Government Advocate is taken on record.
¶7Since, the present contempt petition is filed by the petitioner suppressing the aforementioned fact of disposal of the representation and receiving a copy of the said proceedings on 06.06.2024, this Court had called upon the learned counsel for the petitioner, who had appeared in the morning session, as to why action should not be initiated against the petitioner for approaching this Court with unclean hands by initiating the contempt petition on 27.01.2026 alleging non compliance with the order of this Court in W.P.No.1657 of 2021.
¶8On this Court pointing out the aforesaid fact to the learned counsel for the petitioner, the learned counsel for the petitioner had sought time to verify the said fact from the petitioner and thus, the matter was passed over. The learned counsel for the petitioner was informed that the matter would be taken up at the end of the list. When the matter called at the end of the list, there was no representation.
¶9However, taking note of the fact that the respondents have complied with the order of this Court dated 01.02.2024 and the same also been served on the petitioner, this Court is of the view that the contempt petition filed by the petitioner alleging the willful disobedience of the order of this Court dated 01.02.2024 in W.P.No.1657 of 2021 cannot be proceeded with.
¶10Accordingly, this Contempt Petition is dismissed.
