Judgment

ORDER Mr.S.J. Mohammed Sathick, learned Standing Counsel takes notice for the 1st respondent and Mr.K. Tippusulthan, learned Government Advocate takes notice for the 2nd respondent. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

¶2The relief sought in this writ petition is a direction to the respondents to consider the petitioners representation dated 07.01.2026 and thereby to consider the petitioner's online application dated 12.10.2023 and thereby to include the petitioner's name in the list of Candidates called for Certificate verification for the post of Auxiliary Nurse - Midwife / Village Health Nurse.

¶3It is the case of the petitioner that she is presently employed as an Auxiliary Nurse–Midwife at UPHC, Jalladyanpet, Chennai, for the past 20 months. On completion of school education, she underwent the Auxiliary Nurse –Midwife Course at Vinayaka Missions College of Paramedical Sciences. Pursuant to the Notification dated 11.10.2023 issued by the 1st respondent the petitioner submitted her application on 12.10.2023 for the post of Auxiliary Nurse–Midwife. It is her case that she was not called for certificate verification or interview. Hence, this writ petition.

¶4Learned counsel for the petitioner submitted that it would suffice, if a direction is issued by this Court to the respondents to consider the petitioner's representation dated 07.01.2026 as well as online application, within a time frame to be fixed by this Court.

¶5Per contra, the learned Government Advocate appearing for the 2nd respondent submitted that as per the notification, the minimum qualification required is completion of 18 months Multi-Purpose Health Workers Training Course awarded by the Director of Public Health and Preventive Medicine, along with SSLC and Higher Secondary qualification.

¶6In the present case, the petitioner completed her course at Vinayaka Missions College of Paramedical Sciences, which is not approved by the Director of Public Health and Preventive Medicine. Hence, her application was rejected and the same was published in the official website. Therefore, he prayed for dismissal of this writ petition.

¶7This Court finds that the eligibility criteria prescribed in the notification is mandatory. As rightly pointed out that the petitioner does not satisfy the eligibility conditions prescribed by the respondnets as the qualification acquired by her is not an approved one.

¶8In such view of the matter, this Court is not inclined to issue any positive directions to the petitioner. Accordingly, the writ petition stands dismissed. However, liberty is granted to the petitioner to work out her remedy in the manner known to law. No costs.
