O R D E R This Writ Petition has been filed to direct the respondents to pay interest for the belated payment of provident fund, gratuity, encashment of earned leave, surrender leave and commuted value of pension, at the rate of 12% per annum, within a time frame fixed by this Court.
¶2It is the case of the petitioners that the first petitioner is the wife of late K.G.Shanmuganathan, who was appointed as Conductor in the respondents Transport Corporation and the petitioners 2 and 3 are the son and daughter of the said deceased. He was retired from service on
31.03.2023 and died on 12.08.2023. However, the respondents settled the retirement benefits only on 30.10.2024. Therefore, the petitioners claimed 12% interest on the belated payment of terminal benefits and they have also made representation on 29.10.2025 to pay interest for the belated payment of terminal benefits which has not been evoked any response so far. Hence, the petitioner is before this Court.
¶3Heard the learned counsels appearing on either side and perused the materials available on record.
¶4In view of the limited request made by the petitioners with regard to interest on the belated payment of terminal benefits, this Court directs the respondents to pay interest @ 6% per annum for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the deceased K.G.Shanmuganathan to the petitioners, within a period of six weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits.
¶5Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
