Judgment

Order The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 296(b), 232(1) and 351(2) of BNS, 2023 in Crime No.703 of 2025 registered on the file of the respondent police, seeks anticipatory bail.

¶2The allegation against the petitioner is that he joined hands with other accused and tried to hamper the witness of the POCSO case and also threatened the defacto complainant and her family members. Hence, the present case has been registered.

¶3The learned counsel appearing for the petitioner submitted that the alleged occurrence had taken place on 19.11.2025; that the petitioner was not present at the scene of occurrence and that the petitioner is ready to co-operate with the investigation. Hence, he prays for the grant of anticipatory bail to the petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the POCSO case is pending for framing of charges. She further submitted that the co-accused A3 and A4 were granted anticipatory bail by this Court. Hence, he opposed the grant of anticipatory bail to the petitioner.

¶5Heard the learned counsel appearing for the petitioner and the learned Page3 of 5 Government Advocate (Criminal Side) appearing for the respondent police and perused the materials available on record.

¶6Considering the nature of the allegations, the fact that the petitioner was not present at the scene of occurrence, and taking note of the allegation that the family members attempted to influence the defacto complainant and also threatened her family members, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

¶7Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Chief Judicial Magistrate, Puducherry, on condition that the petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand Only), with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:
