Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

19.12.2025 for the offences punishable under Sections 275, 123, 112 of BNS 2023, and 24(1) of Cigarette and Other Tobacco Products Act, in Crime No.534 of 2025, registered on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that on 19.12.2025 based on a secret information, the respondent police conducted vehicle check up at Kandarakottai check post, intercepted a car bearing Registration No.TN-34-U-5666 and found that the petitioner herein and other accused were involved in illegal transportation of 12000 pouches of Hans, 880 pouches of Cool Lip, 17160 pouches of Vimal Pan masala and 17160 pouches of V-1 Tobacco in the said car. Hence, this case.

3.The earlier bail application of the petitioner was dismissed by this Court, vide order dated 21.01.2026 in Crl.O.P.No.1162 of 2026 for the following reasons: "5. Considering the submissions made, facts and circumstances of the case, huge quantity of contraband involved in this case, the fact that the investigation of this case is pending and the co-accused/ A3 is still absconding, this Court is not inclined to grant bail to the petitioner.

¶6Accordingly, this criminal original petition stands dismissed."

¶4The learned counsel for the petitioner submitted that the petitioner's mother is suffering from pulmonary edema and is currently undergoing treatment at Government Stanley Hospital. He further submitted that the petitioner is the sole caregiver for his mother. Consequently, the learned counsel prayed for the grant of bail to the petitioner on these grounds.

5.I have also gone through the earlier order passed by this Court and considering the other circumstances. I am of the view that there is no change in circumstances warranting the grant of bail to the petitioner. Although it is stated that the petitioner's mother is suffering from severe illness, no material has been produced to substantiate the same so as to convince this Court to grant bail. Hence, this Court is not inclined to grant bail to the petitioner.

¶6Accordingly, this Criminal Original Petition is dismissed.
