Judgment
ORDER Challenging the order of the first respondent in his proceedings in Ka.No. 20301/Ni2/Tha.Na.A.Po.Ka(V).Thi.Malai/ 2020 dated 17.01.2026 and the consequential order passed by the second respondent herein in his proceedings in Letter No. 2641/KiMa/Po.tha.A.Po.Ka(V) Thi.Malai.26 dated 22.01.2026, the present Writ Petition has been filed. Further, the petitioner has sought for a direction to the respondents herein to retain the petitioner at Polur Depot of the respondent corporation.
¶2Heard the learned counsels appearing on either side. With the consent of both sides, the present Writ Petition is taken up for hearing at the admission stage itself. Page3 of 5
¶3It is the case of the petitioner that he joined as Driver in the respondent Corporation on 10.11.20214 and at present working at Polur Deport. All of a sudden without any reason, he was transferred from Polur Depart to Kilambakkam Depot vide proceedings of the first respondent dated 17.01.2026, which was followed by the order of the second respondent dated 22.01.2026, for which he approached the respondents 1 and 2, but there was no response and hence, the present Writ Petition.
¶4The learned counsel for the petitioner drew the attention of this Court to the order passed by this Court in W.P.No.1493 of 2024 dated 01.12.2025 in an identical issue and prayed to allow the Writ Petition.
¶5On a bare perusal of the case reveals that the petitioner was transferred without any valid reason and the same is impermissible as per the order passed by the Principal Labour Court, Chennai in Standing Order Appeal No.4 of 1995 dated 01.04.2022, wherein it has deleted the power available for transfer from one place to another in terms of Certified Standing Order No.28.
¶6In view of the above reasonings and in the light of the orders passed by this Court in W.P.No.1493 of 2024 and W.A.No.2751 of 2025, this Writ Petition is allowed and the impugned orders of the first and second respondent Page4 of 5 are set aside. However, liberty is granted to the respondents to proceed with the matter in accordance with law, if the Certified Standing Order is restored. Consequently, connected Miscellaneous Petition is closed. There shall be no order as to costs. 12-02-2026 Index: Yes/No Speaking/Non-speaking order DP To
