Judgment
ORDER The petitioner, who is an accused in Spl.S.C.No.61 of 2022, was convicted by the trial Court, by the judgment dated 19.01.2024 for offence under Sections 5(l), 5(m), 5(n) r/w 6 of POCSO Act, 2012 and Section 506(i) of I.P.C. and sentenced to undergo twenty years rigorous imprisonment and to pay a fine of Rs.2,500/- for offence under Sections 5(l), 5(m), 5(n) r/w 6 of POCSO Act and sentenced to undergo two years rigorous imprisonment for offence under Section 506(i) of I.P.C. From the date of judgment, the petitioner is in confinement. The petitioner's relatives have not visited him during his confinement and he was not aware about the procedure, hence the appeal could not be filed in time. Thereafter, the petitioner filed an appeal with a delay and also filed a miscellaneous petition in Crl.M.P.No.17049 of 2025 seeking to condone the delay of 527 days. This Court, by an order dated 15.09.2025, condoned the delay on payment of cost of Rs.1,000/- to the District Legal Services Authority, Tiruppur, within a period of one week, which the petitioner could not complied with. Hence, he filed a petition in Crl.M.P.No.23782 of 2025 seeking extension of time and this Court, by an order dated 11.12.2025, granted further period of one week to comply with the condition. Since the Page3 of 4 petitioner has no means and was unable to mobilise the funds, again he could not comply with the condition. Hence, filed the present petition.
¶2On the submissions made and on perusal of the materials, it is seen that the petitioner has been convicted by the trial Court and now he is in confinement. Due to his confinement the delay has caused. The petitioner expressed his inability to mobilise the cost amount of Rs.1,000/-. Finding that the petitioner is presently in confinement, the imposition of costs is not required. Hence, this Criminal Miscellaneous Petition is closed.
¶3In view of the above, the delay stands condoned.
