¶2The case of the prosecution is that the petitioner herein is the driver of the car and due to his rash and negligent driving, he hit against the stationed vehicle in the main road which resulted in causing death of one victim and the another one is still under treatment in the hospital; and hence, a case was registered by the respondent police.

3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and he is in judicial custody from 19.12.2025 and it is not the case of rash and negligent driving, it is an accident happened since the vehicle was stopped in the road during the night hours and the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, prays to grant bail to the petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that due to the accident, one died and other is in the hospital under treatment and there is no previous case as against the petitioner and that the further investigation of this case is pending.
