O R D E R The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 111(2), 123 of BNS r/w. Sections 8(c), 20(b)(ii)(A) and 21(b) of NDPS Act in Crime No.20 of 2026 on the file of the respondent Police, seeks anticipatory bail.

¶2The case of the prosecution is that on 21.01.2026, based on a specific information, the respondent went near Erikarai Pillaiyar Temple and intercepted A1; that after complying all the mandatory provisions of the NDPS Act, the respondent had seized 75 grams of ganja form A1; that based on the confession, further seizure was effected in the house of A2 and recovered 100 nos. of Tapentadol Tablets and arrested A2 to A4; that further A1 confessed that the above seized contrabands were supplied to them by the petitioner herein and another accused namely Ansar. Hence, this case.

¶3The learned counsel appearing for the petitioner submitted that the petitioner is a student pursuing Master's Degree and he has been falsely implicated in this case only based on the confession of the arrested accused; that the petitioner has not committed any offence as alleged by the prosecution and there is no recovery from the petitioner herein; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

¶4The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner herein is the main accused in this case, who had supplied the contraband to other accused for the purpose of illegal sales; and that the investigation of this case is at preliminary stage.

¶5Considering the submissions made on both sides, facts and circumstances of this case, nature of offence and taking note of the fact that the investigation of this case is at preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner.
