¶2Heard the learned counsel on either side and perused the documents.

¶3The petitioner herein seeks for grant of 28 days of ordinary leave, without escort, on the ground that the petitioner's mother has been advised by the doctor to undergo an eye surgery, for which he requires to be with his mother for arranging funds for the treatment. Further, the detenue has undergone 1 years, 8 months and 11 days of imprisonment.

4.The learned Additional Public Prosecutor produced a copy of the Probation Officer's report dated 24.01.2025, in which, the Probation Officer has recommended for grant of leave as the reasons assigned by the petitioner is said to be true. However, the convict prisoner is not eligible for ordinary leave since he has not completed 3 years of imprisonment.

¶5Although the law enforcing agency has not recommended for grant of leave, considering the fact that the Probation Officer has recommended for grant of leave and that the convict prisoner has not availed leave even once, we are inclined to grant leave for a period of 7 days in exercise of our powers under Article 226 of the Constitution of India.

¶6Accordingly, the detenue viz., Ealiya, S/o Ramanayya, aged about 25 years, convict prisoner, bearing Convict No 10309 and PID No. 306515, is hereby granted leave for a period of 7 days, without escort, commencing from 10.00 am on 06.03.2025 to 5 pm of 12.03.2025.
