Judgment
ORDER This Writ Petition (Criminal) has been filed seeking a direction the Respondents 1 to 3 to give police protection to the petitioner to fence the aforementioned property namely properties admeasuring 8.15 cents out of 12 acres comprised in Sy.No.536/8, the property admeasuring 47.77 cents comprised in Sy.No.545/C2, the property admeasuring 6 cents and 1/3rd share in the well with 1/3rd irrigation and channel rights and 1/3rd rights in 5HP electricity service connection in Sy No.305 situated at Marimanikuppam Village, Tirupattur Taluk and District Page3 of 5
¶2It is seen that the petitioner claims title to the subject property under a partition deed and seeks police protection for fencing the property. However, the submissions made by the learned counsel appearing for respondents 4 and 5 reveal that the said partition deed was subsequently reversed and that the petitioner's share in the property was reduced.
¶3That apart, several civil disputes between the petitioner and respondents 4 and 5 in respect of the subject property are pending adjudication. In such circumstances, police protection cannot be granted for fencing the property, as the dispute involves disputed questions relating to title and possession. Therefore, this Court is of the considered view that the present writ petition is devoid of merits.
¶4In view of the above, this Writ Petition is dismissed. However, the petitioner is at liberty to approach the competent Civil Court and seek appropriate relief, if so advised. No costs. 15-07-2026 Index: Yes/No Speaking/Non-speaking order Vv Page4 of 5 To
