Jageesh Kewal Chand Madhu v. The Assistant Commissioner (Brc for Export)

ORDER This Writ Petition has been filed for issuance of a Writ of Mandamus, seeking a direction to the respondents to provide certified true copy of order in original No 84223/ 2021 passed by 1st respondent to petitioner for purpose of appealing against the said impugned order.

¶2At the outset, learned Standing Counsel for respondents would submit that they may have no objection in providing the certified copy of the order-in-original No.84223/ 2021, however, she would submit that in the event of the Page3 of 5 petitioner preferring an appeal, the question as to the date on which the impugned order was served shall be examined independently by the Appellate Authority.

¶3In view of the above, the respondents shall provide the petitioner with the certified copy of the order-in-original No.84223/2021. It is made clear that in case the petitioner prefers to file an appeal, the date on which the impugned order was served shall be examined independently by the Appellate Authority.
