Judgment

ORDER This writ petition has been filed seeking for a direction to respondents 1 to 3 to cancel patta No.400, standing in the name of respondents 4 and 5 and thereafter issue patta in favour of the sons of the petitioner, i.e. Sabapathi, Annamalai and Hariharan for the properties, morefully described in the prayer to this writ petition, based on the petitioner's representation dated 19.01.2026, within a time frame to be fixed by this Court.

2.According to the petitioner, illegally, respondents 4 and 5 have obtained patta No.400 for the properties, morefully described in the prayer to this writ petition. The petitioner has filed supporting documents along with this writ petition in support of his contention that patta No.400, standing in the name of respondents 4 and 5, has to be cancelled. The petitioner had given a representation on 19.01.2026 to the official respondents seeking for cancellation of patta No.400, standing in the name of respondents 4 and 5. Since the same has not been considered till date, the petitioner has filed this writ petition.

3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 3.

4.Since no adverse order is being passed against respondents 4 and 5, notice to respondents 4 & 5 is dispensed with by this Court.

5.No prejudice would be caused to the official respondents if the petitioner's representation, as stated supra, is considered, on merits and in accordance with law, after hearing the objections of respondents 4 and 5 and any other third party whom the second respondent deems it fit to enquire, within a time frame to be fixed by this Court.

6.This Court is not expressing any opinion on the merits of the petitioner's representation.

7.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 19.01.2026 seeking for cancellation of patta No.400, standing in the name of respondents 4 and 5 for the property, morefully described in the prayer to this writ petition and for re-issuance of patta in the name of the sons of the petitioner i.e. Sabapathi, Annamalai and Hariharan for the properties, morefully disclosed in the prayer to this writ petition, after hearing the objections of respondents 4 and 5 and also any other third party whom the second respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order.
