Judgment

ORDER The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS ( 294(b),323,324 and 506(2) of IPC )in Crime No.21 of 2026, on the file of the respondent Police, seeks anticipatory bail.

¶2The case of the prosecution is that due to previous enmity the petitioners attacked the defacto complainant with beer bottle in the forehead and caused injuries to him and also threatened her with dire consequences. Hence, the case.

¶3The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioners.

¶4The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and reported that the injured was discharged from the hospital and the petitioners are not having any previous case. However, he strongly opposed the grant of anticipatory bail to the petitioner. Page2 of 6

¶5Heard both sides and perused the materials available on record. 6 Considering the facts and circumstances of the case, the submissions made by both counsels, and taking note of the fact that the injured discharged from the hospital and there is no previous case as against the petitioner, I am inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

State of Kerala [(2005) AIR SCW 5560];

(e)If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act. 09-02-2026 Index: Yes/No Speaking/Non-speaking order SMN Page4 of 6 To.
