Judgment
ORDER Mrs.P.Selvi, learned Government Advocate, takes notice for the Respondent.
¶2This Writ Petition is being disposed of at the time of admission with the consent of the learned counsel for the Petitioner and learned Government Advocate for the Respondent.
¶3In this writ petition, the petitioner is before this Court against the impugned order dated 20.02.2025 whereby the proposal made in the Show Cause Notice in Form DRC-01 dated 25.11.2024 for the tax period 2020-2021 has been confirmed in respect of two of the defects pointed out in the aforesaid notice. It is noticed that the petitioner had submitted a reply to the aforesaid Show Cause Notice on 30.11.2023, which has been taken into consideration while passing the impugned order.
¶4The learned counsel for the petitioner submits that the petitioner may be given one more opportunity to explain the case.
¶5It is noticed that the limitation for filing an appeal under Section 107 of the respective GST enactments, 2017 against the impugned Order has already Page3 of 6 expired. The present Writ Petition has been filed only on 06.02.2026.
¶6At this stage, the learned counsel for the petitioner further submits that the petitioner is willing to pre-deposit 25% of the disputed tax for the liberty to file an appeal before the Appellate Authority.
¶7The learned Government Advocate for the respondent on the other hand submits that the writ petition is devoid on merits as the petitioner failed to approach the Appellate Authority under Section 107 of the respective GST enactments within the prescribed time.
¶8I have considered the submissions made by the learned counsel for the petitioner and the learned Government Advocate for the respondent.
¶9Following the consistent view taken by this Court under similar circumstances, liberty is granted to the petitioner to file an appeal before the Appellate Authority, subject to the Petitioner depositing 25% of the disputed tax in cash from the Petitioner's Electronic Cash Register within a period of 30 days from the date of receipt of a copy of this order. ¶10In case the Petitioner complies with the above stipulation, the Appellate Authority shall proceed to consider the appeal and pass a final order on merits and in accordance with law, as expeditiously as possible, without reference to limitation on its own turn.
¶11In case the Petitioner fails to comply with any of the stipulations, the Respondent is at liberty to proceed against the Petitioner to recover the tax in accordance with law as if this Writ Petition was dismissed in limine today.
¶12Needless to state, before passing any such order, the Respondent shall give due notice to the Petitioner.
