Judgment

ORDER The present Writ Petition (Criminal) has been filed to direct the first respondent to consider the petitioner's representation dated 24.12.2025 relating to removal of his name in the History Sheet (H.S.No.313/2024) on the file of the second respondent.

¶2The learned counsel appearing for the petitioner submitted that though there was only one case registered against the petitioner in Crime No.132 of 2024, the same was also withdrawn by the complainant, the respondent police opened a history sheet against the petitioner and thereby causing frequent visits to his house which caused mental agony. Therefore, the petitioner made several representations to the first respondent on 09.07.2025,

24.09.2025 and 24.12.2025 requesting to remove his name from the History Sheet. Since no order was passed on the representations of the petitioner by the first respondent, the present Writ Petition (Criminal) has been filed.

¶3The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner had sent representations to the respondents 1 and 2. The Deputy Superintendent of Police, Valparai Sub Division, Coimbatore District, is the authority concerned to consider and Page3 of 4 dispose of the representation of the petitioner but he has not been added as a party. If he is added as a party to this writ petition and a copy of the representation is sent to him, it will be considered and appropriate orders will be passed in accordance with law within a period of four weeks.

¶4Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

¶5Considering the aforesaid submission of the learned Additional Public Prosecutor, the Deputy Superintendent of Police, Valparai Sub Division, Coimbatore District, is suo motu impleaded as third respondent in this case. The petitioner is directed to send a copy of the representation dated 24.12.2025 to the newly impleaded third respondent forthwith and on receipt of the same, the third respondent shall consider and pass appropriate orders on the same on merits and in accordance with law within a period of four weeks thereafter.
