Judgment

ORDER Asserting that the petitioner is the owner of 3120 sq.ft. in S.No.232/13 in the Happy Estates Layout at Mevalurkuppam A village, the petitioner relies on the order dated 22.03.2022 of the Revenue Divisional Officer cancelling the patta issued to respondents 2 & 3. After submitting representation dated

23.01.2026 to the registering officer to make an entry relating to order dated

22.03.2022, the present writ petition has been filed.

¶2Learned counsel for the petitioner submits that documents of conveyance in favour of the third and fourth respondents were registered by the registering officer. Consequently, it is submitted that further conveyances would be effected on the basis by the third and fourth respondents unless the order of the Revenue Divisional Officer is entered in the register of encumbrances. Page3 of 4

¶3Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for respondents 1 & 2.

¶4The petition is completely misconceived. If the petitioner is aggrieved by the registration of conveyances in favour of the third and fourth respondents, the petitioner should approach the jurisdictional civil court challenging such conveyances and seeking a declaration that the same are illegal, null and void. Instead, the petitioner has requested that the order of the Revenue Divisional Officer in proceedings under the Tamil Nadu Patta Pass Book Act, 1983 be entered in the register of encumbrances. The request of the petitioner cannot be countenanced.

¶5Therefore, this writ petition is disposed of by leaving it open to the petitioner to approach the jurisdictional civil court for relief in respect of conveyances in favour of the third and fourth respondents. There will be no order as to costs. 26-02-2026 Index : Yes/No Internet:Yes/No kj Page4 of 4
